This Agreement is made and entered into on this day of_________________by and between L. Michelle Lewis DBA: LeMils (hereafter “Seller”), and ______________________________  (hereafter “Buyer”), for the purpose of setting forth the terms and conditions of the purchase by Buyer of a Purebred Doberman Pinscher from the litter whelped on_____________________.  AKC Litter Registration Number is: ______________________.

For good and valuable consideration, the Seller agrees to sell and the Buyer agrees to buy a (check one)
_____Black _____Red,  _____Male _____Female Doberman, subject to the following:

1.        Seller warrants that the Doberman is a Purebred Doberman Pinscher that can be registered with the American Kennel Club (AKC).  AKC Registration paperwork will be provided along with a true copy of the pedigree.

2.        Seller  warrants to the best of her knowledge the above-described Doberman is in good health and free of disqualifying faults at the time Buyer assumes ownership.  However the Doberman is sold as is.

3.        Seller warrants that the Doberman sold hereunder is progeny of the animals OFA x-rayed.  Buyer agrees to maintain preventative care of the Doberman in regards to hip dysplasia such as proper nutrition (including avoiding excessive nutrition), proper exercise and preventing stress injuries.

4.   The possession of the Doberman will be transferred to the Buyer for the sale price of $_____________U.S.  It will be paid as follows: ______________,  a nonrefundable deposit upon execution of the Agreement and the balance due before the transfer of ownership papers.  If the balance is not paid by _______________, this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder.

5.   The Doberman is sold FOB Phoenix, AZ.  If the Buyer requests delivery of the Doberman outside of Arizona, it shall be by airfreight.  C.O.D. or prepaid to a designated location determined by the Buyer.  The Buyer is solely responsible for costs of crate and insurance during shipping  and cost of freight charges.  Buyer shall reimburse Seller in  full for any costs incurred.

6.A.  __________(Initial) Companion Doberman.  The Seller has determined that this Doberman is sold under a limited  registration contract and the Buyer agrees to spay/neuter not later then 7 months of age.  (If spay or Neuter is not done by age 7 mos. LeMils will recieve $5,000.00 for damages).
 B.  __________(Initial) Co-ownership Show Potential Doberman.  The Doberman will be replaced  if it cannot be shown due to disqualifying faults as specified in the Standard of the Doberman Pinscher Club of America.
C.  __________(Initial)  Other Agreement.  Details are specified in paragraph 18 of this Agreement.

. 6. D. _________(Initial) Outright Sale Show Potential Doberman.    The Doberman will be replaced if it cannot be shown due to disqualifying faults as specified in the Standard of the Doberman Pinscher Club of America.

 7. Doberman will carry the LeMils Kennel Name.  The Buyer will determine the call name of the Doberman.

 8.  ________(Initial) Buyer agrees that he/she is not acting as an agent in the purchase of this Doberman and that Buyer will not sell this Doberman or it's progeny to any agent, pet store, guard dog business or Albino Breeder. (Should the afore-mentioned happen to take place.  LeMils shall receive $10,000.00 in damages).

 9. The Buyer agrees that ownership or possession of this Doberman will not be transferred without the written consent of the Seller.  The Seller will accept the return of this Doberman with AKC Registration Papers at anytime the Buyer declines to keep the Doberman.  This Doberman with Registration Papers Signed over to L. Michelle Lewis will be promptly returned to Seller for attempted placement into a new home.  It is further agreed that Seller has complete and total control over placement of this Doberman once it is returned to the Seller.  The Seller Will Not refund any of the purchase price.

10. All expenses regarding the Doberman including: shipping of the animal, showing, advertising, proper care, veterinary fees, housing, lifting of a non-breeding contract or legal liabilities in owning this Doberman are the sole responsibility of the Buyer or Co-owner at whose home the animal resides.

11. The Buyer agrees to inform and provide copies to LeMils of any titles, awards or medical certifications to include as a minimum date awarded, shows and judges or evaluator involved in issuing this award. These will be used for our breeding records and DPCA or other awards.  The Buyer and Seller mutually agree to inform each other of any change of address and new phone number so that we may keep track of all animals bred.

12. Buyer agrees that the Doberman will reside at their home and will be treated as an integral part of the family.  The Doberman will not be kept tied or tethered, chained or otherwise abused, have access to a fenced yard and will be provided with proper housing, diet, annual shots (including Parvo), year-round heartworm preventative as well as ample amounts of exercise.  The Buyer must not at any time transport the animal in the open cargo area of a vehicle.  Buyer also agrees that this Doberman will not be used as a guard dog for any business.

13. Buyer agrees that a basic obedience-training course will be completed with the Doberman.  Seller agrees to make themselves available for assistance of any nature related to this Doberman, such as training, nutrition, grooming, ear bracing, socialization, etc., as time and distance allows.

14. This Agreement shall constitute the entire Agreement between Seller and Buyer and neither party is bound to any representation, no warranty expressed or implied, undertaking, promise, covenant, condition, term, agreement or inducement not embodied or contained herein.

15. The validity and interpretation of this Agreement and each clause and part therefore, shall be governed by the laws of the State of Arizona.  Litigation arising from this Agreement shall be adjudicated in the County of Maricopa in the State of Arizona.  All parties hereby submit themselves to the jurisdiction of said court.  Should any provision of this Agreement be found or deemed to be illegal, invalid or unenforceable, the remainder of the Agreement shall not be affected thereby.

16. This Agreement is made and signed by both parties to insure the well being and protection of this Doberman.   If  the Buyer  breaches any part of this Agreement, the Seller is released from any obligations under this Agreement.

17. Failure of the Buyer to live up to any part of this agreement will entitle the Seller to reclaim  the Doberman and it's Registration Papers which will be transferred back to the Seller and to not be further obligated to the Buyer in any way whatsoever.

________________(Initial)  Doberman  has been micro-chipped by the Seller.  The Seller will      provide the Buyer with the micro-chip number and micro-chip registration paperwork upon payment in full.

A complete immunization and worming history will be provided  by Buyer.
